Article 1 — Purpose
These terms govern sales of personalised jewellery and gifts made on the Lumelle Paris website between the seller (see legal notice) and any consumer customer. Placing an order means you fully accept these terms.
Article 2 — Products and personalisation
Our products are engraved to order using the text you enter (name, word, date). Images are for illustration: slight differences in colour or engraving appearance are possible. You alone are responsible for the text you enter (spelling, capitals, characters). Please proofread it carefully before confirming: we do not correct what you have written. Once the order is placed, production starts quickly and the text can no longer be changed. We reserve the right to refuse a text that is unlawful or contrary to public decency.
Article 3 — Prices and delivery costs
Prices are shown in euros, all taxes included. VAT not applicable, art. 293 B of the French General Tax Code. Delivery to mainland France is free: the displayed price is the price you pay. For the other European Union countries we serve, a delivery fee of €7.95 is added to the price; it is shown before you confirm your order. The applicable price is the one displayed at the time of ordering.
Article 4 — Order and payment
The order is final once payment is confirmed. Payment is made online by bank card or by the means offered at checkout, through a secure platform. We do not store any banking data. A confirmation is sent to you by e-mail.
Article 5 — Production and delivery
Each product is made to order by our partner workshop in the European Union. Production takes 2 to 5 business days, plus transport time: allow 5 to 10 business days in total between order and delivery. These times are indicative. In case of significant delay, please contact us. The risk of loss or damage passes to you on delivery. Check your parcel on receipt and report any problem without delay.
Article 6 — Right of withdrawal: exclusion
In accordance with article L221-28 3° of the French Consumer Code (Article 16(c) of Directive 2011/83/EU), the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. As our products are engraved on request, they cannot be taken back, exchanged or refunded if you simply change your mind. This information is given to you before ordering and repeated on each product page.
Article 7 — Legal guarantees
The exclusion of the right of withdrawal does not affect your legal guarantees. You benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). If your product is defective, damaged or does not match your order (for example, an engraving different from the validated text), write to us at lumelleparis@gmail.com within 14 days of receipt, with your order number and photos. We will replace or refund it, at your choice where possible.
Article 8 — Liability
Our liability cannot be engaged for errors due to the text provided by the customer, or for damage resulting from misuse of the product. Jewellery should be protected from seawater, perfumes and chemicals to keep its appearance.
Article 9 — Intellectual property
The images, texts and trademarks of the site remain the property of Lumelle Paris. The customer warrants that they are entitled to use the text or design they ask to have engraved.
Article 10 — Personal data
The processing of data is described in the privacy policy.
Article 11 — Mediation, applicable law and disputes
In case of a dispute, please contact us first to find an amicable solution. Failing that, you may use, free of charge, the consumer mediator indicated in the legal notice. These terms are governed by French law. The competent courts are those provided for by law.
